1Introduction

This Acceptable Use Policy ("AUP" or "Policy") governs the use of Flashcart Pvt. Ltd.'s omni-channel messaging services. It is designed to ensure compliance with Meta Platform Policies, protect users, and prevent abuse.

Purpose

  • Compliance with WhatsApp/Meta policies
  • Prevent spam and harassment
  • Maintain platform integrity

Consequences

  • Service suspension
  • Account termination
  • Legal action for severe violations

3Prohibited Uses and Content

Spam & Unsolicited

  • No Cold Messaging: Only message users who opted in.
  • No Purchased Lists: Cannot use bought or scraped data.
  • No Mass Spamming: Bulk messages without consent are banned.
  • Honor Opt-Outs: Stop messaging upon request immediately.

Illegal & Harmful

  • Illegal Goods: Drugs, weapons, counterfeit items.
  • Adult Content: Pornography or sexually explicit material.
  • Harmful Content: Hate speech, violence, self-harm promotion.
  • Fraud: Scams, phishing, impersonation.

4Meta Platform Compliance

WhatsApp Business Policy

Opt-In: Must use active, explicit opt-in methods.

24h Window: Marketing only allowed via templates if outside 24h window.

Templates: Must be pre-approved and non-promotional (unless marketing category).

Quality: Maintain high quality rating to avoid bans.

Messenger & Instagram

  • Entry Points: Users must initiate (e.g., reply to story, click ad).
  • Tags: Use correct tags for updates; no promo tags.
  • Professional Account: Instagram requires Business/Creator account.

6Opt-In & Opt-Out Requirements

Valid Opt-In Methods

  • Website forms (unchecked box).
  • In-person verbal/written consent.
  • Click-to-Chat links.
  • SMS keyword triggers.

Invalid Methods

  • Pre-checked boxes.
  • Purchased or scraped lists.
  • Assumed consent (e.g., from business card).
  • Hidden terms in T&C.

8Enforcement & Consequences

Warning email, guidance, and opportunity to correct.

Temporary suspension (7-30 days), features restricted.

Permanent termination, ban, reporting to Meta/Authorities.
